X. Appeal of Decision to the Provost and Vice President for Academic Affairs
A. The appealing party must explain, in writing, the basis on which the party appeals, i.e.:
a. A procedural irregularity that affected the outcome of the matter;
b. New evidence that was not reasonably available at the time the determination regarding responsibility or dismissal was made, that could affect the outcome of the matter;
c. Evidence that Title IX Coordinator, investigator, or decision-maker had a conflict of interest or bias that affected the outcome of the matter; or
d. Additional grounds as provided by the appealing party to all parties.
B. The Provost and Vice President for Academic Affairs will issue a written response to the appeal as promptly as possible. This decision will constitute Cumberland’s final decision on the complaint. The Complainant and Respondent shall be simultaneously notified of the Provost and Vice President for Academic Affair’s decision in writing by the Title IX Coordinator.
